Spybot Search & Destroy..it contains spywear ???

Your's is the first report I've read on this. Having said that, I know the folks at the SpywareInfo forums watch things like this very closely, and the "switchboards would be red-hot" if that were the case. Where did you get your information?

Anyway, that is my view.

And where exactly would this "hearing" be taking place?

What you MAY of heard is that Ad-aware seems to think that spybot is spyware when it does a scan, and that Spybot seems to think that Ad-aware is

Both programs openly admit to this and tell you to ignore the warning.

You may be thinking of spyware nuker which IS genuine spyware, despite claiming to eliminate spyware

SpyBot does not contain spyware,neither does AdAware.
